Terms of Service

1. Who we are and acceptance of these terms

Welcome to cruise-port.com (the "Services"), operated by Cruise Port ("we", "us", "our"), an independent business established in Spain.

A business correspondence address and legally required business-identification details may be provided to competent authorities, regulators, courts, payment providers, or consumers where legally required by applicable law.

By accessing or using cruise-port.com β€” including the website, any mobile applications we publish, the Plan My Port Days paid product, and any white-label deployments operated by our partners β€” you agree to these Terms of Service (the "Terms"). If you don't agree, don't use the Services.

We may update these Terms occasionally. Material changes will be notified via the site and, where applicable, by email. Your continued use of the Services after a change means you accept the updated Terms.

Translations into other languages (Dutch, French, German, Spanish, Italian, Portuguese) are provided for convenience only. To the maximum extent permitted by applicable law, the English-language version of these Terms governs and prevails in the event of inconsistencies between translations.

2. Who can use cruise-port.com

You can use cruise-port.com if:

  • You are at least 16 years old (or the digital-consent age in your country, whichever is higher)
  • You have the legal capacity to enter into a contract
  • You agree to comply with these Terms and applicable law
  • You are not the subject of any sanctions, export controls, or trade restrictions that would prohibit you from using the Services

You may not use the Services if you have previously been suspended or banned by us.

3. Your account

To access most features, you'll need to create an account. You agree to:

  • Provide accurate information when registering
  • Keep your password and access credentials secure
  • Notify us immediately of any unauthorised use of your account
  • Be responsible for all activity under your account

You can delete your account at any time via your account settings. After deletion, your personal data is removed in accordance with our Privacy Policy, except for records we are legally required to retain (such as invoices and fraud-prevention logs).

4. How you may use the Services

4.1 Permitted use

You may use the free portions of cruise-port.com to:

  • Browse port information, destinations, things to do, transport guides, and other published content
  • Create a profile and contribute reviews, photos, and tips (subject to community guidelines below)
  • Track ports you have visited and ports you'd like to visit
  • View teaser previews of paid features (such as truncated uncertainty indicators and excursion-vs-DIY snippets)
  • Use any other free interactive features we make available

You may use the paid Plan My Port Days product (described in Section 5) for the cruise you have purchased it for, and for that cruise only.

4.2 Prohibited use

You agree not to:

  • Use the Services to break any applicable law
  • Reproduce, sell, resell, redistribute, or commercialise any part of the Services or any content obtained from them (including itineraries, port data, or downloaded PDFs) without our written permission
  • Scrape, mass-download, crawl, or systematically extract data from the Services through automated means, including using the Services to train any machine learning or artificial intelligence model
  • Upload malicious code, spam, or content that infringes any third party's rights
  • Impersonate anyone, misrepresent your affiliation, or use a fake identity
  • Attempt to bypass authentication, payment, paywall, or access controls
  • Reverse-engineer the Services or any part of them, except where this restriction is prohibited by applicable law
  • Use the Services in a way that disrupts or harms other users
  • Use the Services to provide a competing port-information or shore-excursion-planning product

5. Plan My Port Days β€” paid features

5.1 What you get

A Plan My Port Days purchase unlocks paid features for one specific cruise β€” including the multi-port itinerary, customised PDF, favourites and filters, the full uncertainty-indicator breakdown, live arrival/departure times, ship docking information, and any additional paid features in force at the time of purchase.

Pricing is per cruise plan, not per person β€” one purchase covers the whole travelling party. The buyer may share the resulting itinerary and PDF with the people travelling with them on the same cruise. The four tiers are:

USD-equivalent prices are shown for convenience; the actual billed amount is determined by Stripe's currency conversion at checkout.

Prices, tiers, and feature sets may change over time. The price you pay at purchase is fixed for that purchase. Features described as "coming soon" or marked as beta may not be available for the full duration of your access window β€” see Section 7.5.

5.2 Access window

A Plan My Port Days purchase is active from the moment of purchase until 24 hours after your cruise's scheduled disembarkation date. After that window, paid features are no longer accessible. You can buy a new plan for a new cruise.

If your cruise line reschedules your cruise, we will extend the access window to cover the new dates at no additional cost β€” contact hello@cruise-port.com with the updated booking confirmation.

5.3 Single cruise

A Plan My Port Days purchase covers exactly one cruise. It is non-transferable to a different cruise, non-shareable outside the travelling party on that cruise, and tied to your account.

5.4 Port coverage

cruise-port.com aims to cover every port your cruise visits in depth, but not every port has full database coverage yet. We show you the coverage level for your specific cruise before you buy. If at the time of purchase fewer than 75% of your cruise's ports have full coverage, you are entitled to a full refund under our Refund Policy.

For ports without full coverage, we provide a basic information fallback so you are not left with nothing.

5.5 Refunds

Refund eligibility is described in our Refund Policy. Briefly: full refund if you haven't used any paid features and your cruise hasn't started, full refund if your cruise is cancelled by the cruise line, full refund if port coverage is below 75% at purchase, and generally no refund once the cruise has begun unless the Services materially failed due to a fault on our side. EU consumer rights under Directive 2011/83/EU are preserved.

6. User-generated content

Some features of cruise-port.com let you contribute content (port tips, photos, day-trip reports, reviews, etc.) ("Your Content").

6.1 You own Your Content

You retain all ownership of Your Content. By submitting it to cruise-port.com, you grant us a non-exclusive, royalty-free, worldwide, sublicensable licence to display, reproduce, adapt, translate, and distribute Your Content as part of operating and promoting the Services. This licence survives the deletion of your account only to the extent your Content remains visibly attributed to a former username β€” you can request removal of any specific content at any time by emailing hello@cruise-port.com.

6.2 You are responsible for Your Content

You represent that:

  • Your Content is yours to share β€” you own it or have permission from the rights holder
  • Your Content does not infringe any copyright, trademark, privacy right, or contractual obligation
  • Your Content is not defamatory, harassing, hateful, sexually explicit, or otherwise unlawful
  • Information you provide in Your Content (opening times, prices, transport details, etc.) is, to the best of your knowledge, accurate at the time of submission β€” but you understand we do not warrant its ongoing accuracy and other users should not rely on it as authoritative

We may remove Your Content at our discretion if we believe it violates these Terms or applicable law. We may also suspend or terminate accounts that repeatedly violate these guidelines.

7. Disclaimers β€” accuracy, third-party data, and what we are NOT responsible for

This section sets out the practical reality of running an information service about ports, cruises, and shore experiences that change constantly. Read it carefully. To the maximum extent permitted by applicable law, including Spanish and EU consumer law:

7.1 Information is for guidance only β€” not authoritative

cruise-port.com provides general informational content about cruise ports, attractions, transport options, shore experiences, and cruise itineraries. We make reasonable efforts to keep this content accurate and up to date, but we make no warranty, express or implied, that any of the following is correct, complete, or current at the time you act on it:

  • Port arrival, departure, or all-aboard times
  • Cruise itineraries, port calls, ship assignments, dock or terminal assignments, or tender vs. alongside designations
  • Attraction opening hours, ticket prices, closure dates, or admission policies
  • Restaurant, cafΓ©, or shop opening hours and prices
  • Public transport schedules, routes, fares, or service availability
  • Taxi or rideshare availability, fares, payment methods, or wait times
  • Walking times, driving times, and traffic conditions
  • Weather forecasts and sea conditions
  • Visa, health, customs, currency, or border-control requirements
  • Safety, security, or accessibility conditions at any location
  • Prices and content of shore excursions sold by cruise lines or third-party operators
  • Coordinates, maps, and points of interest

Ports, cruise itineraries, and local conditions change β€” sometimes with no notice. You must verify any time-critical or safety-critical information directly with the relevant authority (your cruise line, the port authority, the attraction operator, the transport provider, the relevant government agency) before relying on it.

7.2 Third-party data sources

cruise-port.com aggregates information from multiple third-party sources, including but not limited to:

  • Cruise schedule and ship data sourced from third-party data providers (currently Widgety)
  • Map data and coordinates sourced from OpenStreetMap and rendered through MapLibre and Mapbox
  • Weather data sourced from third-party weather providers
  • Translations generated with the assistance of machine translation and large language models
  • Photographs, descriptions, and operational data sourced from cruise lines, port authorities, tourist boards, and other publishers

We do not control these sources and cannot guarantee their accuracy, completeness, or availability. If a third-party source is wrong, outdated, or unavailable, the corresponding information on cruise-port.com may be wrong, outdated, or unavailable too. We are not liable for any loss arising from inaccuracies or omissions in third-party data.

7.3 AI-generated content

Some features of cruise-port.com β€” including but not limited to Plan My Port Days itineraries, summaries, and personalised suggestions β€” are produced with the assistance of artificial intelligence models (currently provided by Anthropic and OpenAI). AI-generated content can contain errors, hallucinations, outdated information, or recommendations that are unsuitable for your specific situation.

You agree that:

  • AI-generated content is provided "as is" for your convenience and inspiration
  • You will exercise your own judgement before acting on any AI-generated recommendation
  • We are not liable for any loss arising from your reliance on AI-generated content

Users remain solely responsible for making independent travel, timing, transportation, safety, and booking decisions.

7.4 Cruise schedule changes, port substitutions, and missed ports

Cruise itineraries change. Cruise lines reschedule departures, substitute ports, skip ports for weather or operational reasons, change tender/alongside arrangements, and reassign berths. We have no control over any of this. Once you have purchased a Plan My Port Days plan, your itinerary content reflects the cruise as we understood it at the time of generation. If your cruise changes after that:

  • We will regenerate affected port-day content on request where practical
  • We are not liable for content that becomes inaccurate because the underlying cruise changed
  • A change to your cruise itinerary is not, by itself, grounds for a refund (see the Refund Policy)

7.5 Beta features and "coming soon" features

Some features may be released as beta, preview, or "coming soon". Beta features may be modified, suspended, or withdrawn at any time without notice. We do not warrant that beta features will perform as described, will be available throughout your access window, or will be retained in the final product.

7.6 Ship-return timing β€” your responsibility

Some paid features estimate the travel time back to your ship. These estimates are guidance only. You are solely responsible for returning to your ship before its all-aboard time. We do not guarantee the accuracy of route, traffic, walking-time, or location data, and we are not liable if you miss your ship, including for any cost of catching up to the ship at the next port, accommodation, flights, or any other consequential loss.

Always confirm departure times directly with your cruise line and allow a substantial safety margin.

7.7 Maritime, travel, and personal safety

cruise-port.com is not a maritime safety service. We do not provide tide tables, weather warnings, navigational guidance, or emergency response. In any emergency, contact your cruise line, the local emergency services, or your country's consular services. You are responsible for your own safety, your travel insurance, and your compliance with the laws of every country your cruise visits.

7.8 No medical, legal, or financial advice

Nothing on cruise-port.com is medical, legal, tax, or financial advice. For those, consult a qualified professional.

7.9 Third-party links and affiliate links

The Services may contain links to third-party websites (cruise lines, booking platforms, transport operators, attractions, etc.). Some of those links may be affiliate links β€” meaning we may receive a commission if you make a purchase via the link, at no additional cost to you. We do not control third-party sites and are not responsible for their content, terms, privacy practices, or pricing. Visiting a third-party site is at your own risk.

7.10 Service availability

The Services are provided "as is" and "as available". We do not warrant that the Services will be uninterrupted, error-free, timely, secure, or free of viruses or other harmful components. We may schedule maintenance, modify, suspend, or withdraw any part of the Services at any time. Where reasonable, we will give advance notice of planned changes.

8. Intellectual property

The cruise-port.com brand, logo, design, content (other than Your Content), database structure, software, and underlying code are owned by us or our licensors and protected by copyright, database rights, trademark, and other laws. You receive no licence to any of these except the limited right to use the Services as described in these Terms.

You may not use the cruise-port.com brand, logos, or content in any way that suggests endorsement of or affiliation with you or your business without our prior written permission.

9. Indemnification

To the maximum extent permitted by applicable law (and subject to your rights as a consumer under Spanish and EU consumer law), you agree to indemnify and hold harmless cruise-port.com, its operators, employees, contractors, and agents from any claim, loss, damage, liability, or expense (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your User-Generated Content
  • Your use of the Services in violation of applicable law
  • Your infringement of any third party's rights

This indemnity does not apply to claims caused by our own negligence or wilful misconduct, and nothing in this clause restricts your statutory consumer rights.

10. Limitation of liability

To the maximum extent permitted by law:

  • Our total aggregate liability for any claim arising from your use of the Services is capped at the greater of (a) the amount you have paid us in the 12 months before the claim arose, or (b) €50.
  • We are not liable for indirect, consequential, incidental, or special damages β€” including lost profits, lost data, lost cruises, missed all-aboard times, alternative travel arrangements, accommodation, or any other downstream cost.
  • We are not liable for failures caused by events outside our reasonable control (force majeure), including but not limited to internet outages, third-party API or data-provider failures, weather, strikes, port closures, geopolitical events, pandemics, and acts of authorities.
  • To the maximum extent permitted by applicable law, we are not responsible for losses arising from reliance on inaccurate, incomplete, delayed, unavailable, or outdated information published on the Services, including third-party data and AI-generated content.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Spanish or EU consumer protection law, including liability for death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, and any other liability that cannot be limited by contract.

11. Suspension and termination

We may suspend or terminate your account if we reasonably believe you have breached these Terms, applicable law, or have harmed other users. We will tell you why where reasonable.

You may stop using the Services and delete your account at any time. Termination does not affect any rights or obligations that have already arisen, including payment for purchases and the disclaimers and limitation-of-liability clauses, which survive termination.

12. Disputes and governing law

These Terms are governed by Spanish law. Any dispute that cannot be resolved informally will be brought before the competent courts of Alicante, Spain β€” except that, if you are a consumer resident in another EU country, you may bring proceedings in the courts of your country of residence as required by EU consumer law.

EU consumers also have access to the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr, and to the Spanish consumer arbitration system (Sistema Arbitral de Consumo).

13. Miscellaneous

Notices. We may give you notice via email to the address on your account, or via the Services. You may give us notice via hello@cruise-port.com.

Assignment. You may not assign or transfer your rights under these Terms without our written permission. We may assign or transfer our rights under these Terms β€” for example, as part of a business sale or restructuring β€” provided your rights are not materially reduced.

Severability. If any part of these Terms is held invalid or unenforceable, the remaining parts continue in full force and effect, and the invalid part will be replaced with a valid provision that comes closest to its intended purpose.

No waiver. A delay or failure by us to enforce any right under these Terms does not waive that right.

Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy referenced in them, are the entire agreement between you and us regarding the Services and supersede any prior agreements.

No agency. Nothing in these Terms creates any partnership, agency, employment, or joint-venture relationship between you and us.
